This is an appeal by John M. Rucker defendant below from the district court of Rogers county, Oklahoma, wherein he was charged, tried, convicted and sentenced to a term of five years and one day in the penitentiary on a charge of obtaining $4,100 from Frank Dowell by means of what is known as a “confidence game” under the provisions of Title 21 O.S.A. 1941 § 1541, the pertinent portions of which are set out as follows :
