This case arises from a claim for a refund of the sum of $1,050 which the claimant paid to the State Tax Commission, under protest, on August 29, 1936.

The claimant Terminals and Transportation Corporation (hereinafter referred to as the New Company) is a Delaware corporation, duly authorized to do business in New York State.
