MEMORANDUM-DECISION AND ORDER

INTRODUCTION
Plaintiff, a Command Sergeant Major in the Army Reserves, commenced this action under 38 U.S.C. section 2022 (Supp. 1988), after being terminated from his employment, on September 8, 1986, as a full-time permanent managerial employee with defendant, alleging a violation of provisions protecting employment rights of reservists who are called to Active Duty Training (ADT).
