*868In an action, inter alia, for a judgment declaring a certain mortgage of record to be invalid and directing the County Clerk of the County of Nassau to cancel and discharge the mortgage, the plaintiff appeals from an order of the Supreme Court, Nassau County (Bucaria, J.), dated September 10, 2010, which denied her motion for summary judgment on so much of the complaint as sought a judgment declaring the mortgage to be invalid and directing the County Clerk of the County of Nassau to cancel the mortgage.

Ordered that the order is affirmed, with costs.
