KNAPP, Circuit Judge.

This is a negligence action of familiar type, and the facts in outline appear to be these:

Plaintiff in error, defendant below and hereinafter so called, was building a dam for the United States government across the Ohio river near Woodland, W. Va., and Blake, who brings the suit, was a common laborer employed in that work. A large cofferdam had been constructed, extending up and down the river, and the general purpose of the work in hand at the time of the accident was to pump the water out of the cofferdam.
