Appeal from a judgment of the County Court of Chemung County (Castellino, J.), rendered May 3, 1996, upon a verdict convicting defendant of the crime of bail jumping in the second degree.

In August 1990, defendant was convicted of five counts of sodomy in the third degree but pursuant to an order of this Court, he was permitted to remain free on bail pending his appeal. After defendant’s conviction was affirmed by the Court of Appeals, defendant was served by County Court with a notice to surrender at the Chemung County Courthouse to commence service of his sentence.
