Reversing.
This is the second appeal of this case. The former one was styled “Union Gas & Oil Co. v. Gillem,” and the opinion therein is reported in 212 Ky. 293, 279 S. W. 626. The judgment there involved was reversed for reasons stated in the opinion, and upon a return of the case it was manifested by an amended pleading that since it was rendered and before the issuing of the mandate the Union Oil & Gas Company sold all of its interest in the matters here involved, as well as in all others, to the Swiss Oil Corporation, and by appropriate orders the latter…
