Appeal by the defendant, The Bleecker Street and Fulton Ferry Bailroad Company, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Mew York on the 27th day of Hay, 1910, upon "the decision of the court, rendered after a trial at the Mew York Special Term, overruling the said defendant’s demurrer to the complaint.

This action is brought by the People to have certain parts of 'special grants or franchises to construct and operate a street railway in certain streets and public places in the borough of .Manhattan, New York, forfeited, vacated and annulled on the ground that they are being unlawfully held and used by the appellant and the other defendants other than the city of New York, and to oust and exclude them therefrom. The theory of the action with respect to part of the relief sought is that the rights have been forfeited by failure to fully construct and operate the railroad…
