— This cause is brought here from the equity side of the Circuit Court of Madison.
From the exhibits and proof, it appears,, that from eighteen hundred and sixteen, up to the fall of eighteen hundred and twenty, the defendant, Jesse Kear-ny, and his intestate, Charles Burruss, were engaged in the mereautile business in Huntsville. At the latter period, the concern was dissolved, and intelligence of that fact communicated to the plaintiff, in the spring of eighteen hundred and twenty-one, by one who had been their clerk.
