The plaintiffs Otis and Arlene Jenner brought this action seeking declaratory relief and damages under the civil rights statute 42 U.S.C. § 1983 alleging that the defendants Eva and Lawrence Shepherd, and their son Steve Shepherd (the “Shepherds”) had deprived them of property without due process by detaining their personal property pursuant to the common law innkeepers lien codified at Ind.Code 32-8-27-2 and made applicable to mobile home owners by Ind.Code 13-1-7-33.
