This action is brought to recover of the defendant, which is a life and accident insurance company, organized upon the co-operative or assessment plan, the sum of $5,000, in pursuance of a certificate of membership issued to one Oharlés S. Washburn, of Carlton, N. Y., for the benefit of the plaintiff, who is the father of the assured. The policy was issued on the 3d day of November, 1886. On the 5th day of November, 1887, in the vicinity of Cooperstown, Pa., near a highway, in the center of a cleared space, which was surrounded by underbrush, the body of the assured was found with a bullet…
