Appeal from an order of the Supreme Court, Cayuga County (Mark H. Fandrich, A.J.), entered March 30, 2010 in a personal injury action. The order denied defendant’s motion for summary judgment dismissing plaintiffs complaint.
It is hereby ordered that the order so appealed from is unanimously reversed on the law without costs, defendant’s motion is granted and the complaint is dismissed.
