Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered April 29, 2004, convicting defendant upon his plea of guilty of the crime of manslaughter in the first degree.

Following a shooting death in the City of Binghamton, Broome County, defendant was charged with murder in the second degree, criminal possession of a weapon in the second degree and criminal possession of a weapon in the third degree.
