The defendant pled guilty to two separate indictments charging delivery of controlled substances on May 12,1972, in violation of section 401(c) of the Controlled Substances Act (Ill. Rev. Stat. 1971, ch. 56½, par. 1401(c)). On November 23, 1973, he was placed on a 3-year term of probation. On August 9, 1974, he was arrested and charged with the offense of unlawful distribution of a controlled substance.
