Plaintiff in error was defendant in the trial court and will be referred to as Orebaugh or defendant. Defendant in error was plaintiff and will be referred to as Doskocil or plaintiff.

On March 31, 1959, Doskocil filed in the District Court of Baca County a complaint in forcible entry and detainer against Orebaugh, who was served with a copy of the complaint and summons on April 3, 1959.
