This is an appeal from a decree of the circuit court of Washington county, to reverse proceedings had therein to foreclose a mortgage, in which one J. F. Brockschmidt was complainant and Henry Hagebusch and Onesia, his wile, were defendants.

It appears that, on the 3d day of October, 1860, the defendant Hagebusch executed and delivered to complainant, Brockschmidt, his note for one thousand one hundred and ninety dollars, payable four years after date, with interest at ten per cent.
