Appellee Lawther Grain Company, p. partnership, brought this suit against J. L. Winniford and the appellant First State Bank of Santa Anna, Tex., a banking corporation organized under the statutes of Texas. The case was tried before the court without the intervention of a jury and resulted in a judgment in favor of appellee, from which the hank alone appeals.
