I. FACTS AND PROCEDURAL HISTORY
This cause is before the court on a Motion for Class Certification filed by James K. *642Benefield (“Benefield”) and Donald Ray Johnson (“Johnson”) (collectively “the Plaintiffs”) on June 1, 2010 (Doc. # 87).
