Appeal from First Judicial District Court, Parish óf Caddo; E. P. Mills, Judge. Suit by the Kansas City Southern Railway Company and others against B. R. Hendricks, Mayor, and others, to annul a bond issue. From a judgment restraining the sale of the bonds for less than par, but in all other respects rejecting plaintiffs’ demands, plaintiffs appeal.

This is a suit brought to annul a bond issue authorized by the taxpayers of Cedar Grove, and, in the alternative, to enjoin the municipal authorities from disposing of the bonds otherwise than at par and for cash, and also to enjoin them from levying and collecting a tax to retire the bonds until they have been sold.

The suit grows out of an effort on the part of the municipal authorities to raise money with which to construct certain works of public improvement. In order to accomplish this purpose, the town council submitted to the duly qualified property tax payers of the municipality a…
