This is the second child dependency and custody case involving this mother to come before the court. See Carter v. Jefferson County Department of Pensions and Security, 496 So.2d 66 (Ala.Civ.App.1986). The same issues are raised in this case as were raised in the first: whether there was clear and convincing evidence to support the trial court’s finding of dependency; whether the ore tenus presumption in favor of the trial court judgment should apply; and whether the juvenile court properly had jurisdiction of the case.
