ON RETURN TO REMAND
The appellant, Larry Dennis Roy, was indicted for capital murder in the killing of David Wayne Brown, the boyfriend of the appellant's ex-girlfriend. The jury found the appellant guilty as charged in the indictment and recommended a sentence of death. The trial judge accepted the jury's recommendation and sentenced the appellant to death.
On January 13, 1995, this court remanded this cause to the circuit court with instructions that it conduct an evidentiary hearing to determine whether the State had exercised its peremptory strikes in such a manner so as to discriminate…
