Appeal by defendant from a judgment of the Supreme Court, Kings County (Hellenbrand, J.), rendered August 11, 1983, convicting him of assault in the first degree, criminal possession of a weapon in the second degree and criminal use of a firearm in the second degree, upon a jury verdict, and imposing sentence.
Judgment affirmed and case remitted to the Supreme Court, Kings County, for further proceedings pursuant to CPL 460.50 (subd 5).
