This matter comes before the court on the auditor’s rule to show cause why an attachment should not issue against plaintiff for noncompliance with the order of this court dated October 21, 1957, which awarded the auditor’s fee and directed payment thereof by plaintiff. Plaintiff filed *792preliminary objections to the aforesaid petition alleging that the Act of July 12, 1842, P. L. 339, 12 PS §257, abolished such an attachment.
