Defendant Rhondell Miles is charged with criminal possession of a controlled substance in the seventh degree, a misdemeanor under Penal Law § 220.03, and the traffic infraction of riding as a passenger in an automobile without wearing a seat belt on June 16, 2003. Defendant Miles moves to suppress the evidence obtained as a result of the allegedly illegal inventory search of the automobile in which he was riding, and the statements he made to the police.
