STATEMENT OF FACTS

Defendant, Mervin R. Lutz, Canton Grade School Principal and Teacher, appeals an assault and battery conviction for paddling a pupil. He with good reasi t. believed the pupil, eleven year old Samuel Kafidies, had thrown a stone while on the way to school at a little girl schoolmate, and then fibbed about it. The stone knocked the little girl’s glasses off and might have seriously injured her eyes. The paddle used was of normal proportions. He was severely spanked from six to fifteen times.
