Plaintiff Kathleen Loan (Loan) has brought the present action seeking damages for injuries she sustained when she tripped over a depression in the sidewalk surrounding a sewer shutoff valve in front of 106 Dorchester Street. Her complaint alleges that the defendant, Boston Water and Sewer Commission (BWSC) was negligent in maintaining its property (Count I) and seeks consequential damages for the injuries she sustained due to its alleged negligence (Count II).
