Plaintiff in error, hereinafter called defendant, was convicted in the district court of Seminole county of the crime of manslaughter in the first degree in the killing of Claud Long, and his punishment fixed by the jury at imprisonment in the state penitentiary for a period of 15 years.
It is first contended the trial court erred in overruling defendant’s motion for a continuance.
The case was originally set for trial on the 4th day of January, 1932. When called for trial, defendant presented his motion for a continuance, and the case was continued for a period of ten days to enable defendant…
