Order, Supreme Court, Bronx County (Hansel McGee, J.), entered July 7, 1989, which denied plaintiff’s motion for summary judgment, pursuant to CPLR 3212, on the first cause of action of the amended complaint upon the ground that there are no triable issues of fact, unanimously modified, on the law, to the extent of granting plaintiff’s motion as to liability and otherwise affirmed, without costs.
