GARWOOD, Circuit Judge:

Appellant Jeffrey Acklen (Acklen) appeals the district court’s denial of his petition for relief under 28 U.S.C. § 2255. We vacate and remand.

Facts and Proceedings Below

On January 25, 1990, a federal grand jury returned a twelve-count indictment charging Acklen with a variety of drug-trafficking offenses for which Acklen acted primarily as financier. In March 1990, the government agreed to dismiss the indictment in exchange for Acklen’s plea of guilty to a bill of information.
