Henry Haygood was convicted of criminal domestic violence (CDV) in magistrate’s court. Upon appeal to the circuit court, *426his conviction was affirmed. We reverse and remand for a new trial.

FACTUAL/PROCEDURAL HISTORY

Haygood appeared before Magistrate Samuel A. Daily for a bench trial on the charge of CDV.
