OPINION

TERRY McCALL, Justice.

This is an appeal from a bail bond forfeiture proceeding. 1 Marco Steven Enriquez was arrested and charged with the offense of possession of a controlled substance. 2 He and his surety, Christopher Spears, posted a bail bond in the amount of $5,000 on the charge. An indictment on the possession charge was filed on May 14, 2009, and a hearing on the case was set for August 27, 2009. Enriquez did not appear for the hearing on August 27, 2009.
