MEMORANDUM AND OPINION
WILLIAM R. GREENDYKE, Bankruptcy Judge.
Pending before the Court are the Defendant’s Motion for Summary Judgement, or, alternatively, Motion for Dismissal under Rule 12(b)(6) and/or 12(b)(7) and/or Rule 9(b) of the Federal Rules of Civil Procedure. Having considered the Plaintiffs objections, the Defendant’s response, and the applicable law, the Court is of the opinion that the Defendant’s Motion for Dismissal should be granted.
