January 29th, 1920, the parties to this action entered into a contract in writing wherein defendant agreed to sell and plaintiff contracted to purchase specific real estate, in the city of New York, upon which was located an apartment house. The contract provided the consideration to be paid and received; for the payment of five thousand dollars on signing the contract and payment of an additional sum together with a bond and mortgage to be given for the balance on the closing day which was fixed at 12 o’clock noon, April 1st, 1920.
