This action was brought to procure a judgment rescinding the sale of the stock and good will of the business hereinafter mentioned, for an injunction restraining and enjoining the defendant from disposing of or collecting a promissory note,. given in part payment of the purchase money, and for a recovery of the consideration paid to the defendant on the execution of the contract of sale. On the 16th day of March, 1891, the defendant, who was doing business under the name of the Goldsmith Piano & Organ Manufacturing Company, entered into an agreement in writing with the plaintiff, whereby the…
