MEMORANDUM
WARRINER, District Judge.
Plaintiff filed suit 20 March 1978 in the Circuit Court of King William County against Perdue Incorporated (hereinafter “Perdue”) and Ring Around Products, Inc. (hereinafter “Ring Around”), seeking damages allegedly resulting from the use of soybean seeds purchased from Perdue. Defendant Perdue filed its grounds of defense, demurrer, and cross-claim in the Circuit Court of King William County 14 April 1978. Subsequently on 21 April 1978 defendants Perdue and Ring Around filed separate petitions for removal in this Court. Plaintiff filed a “motion to dismiss…
