MORROW, Judge.
Appellant was charged with a,n assault with intent to rape Etta Mae Harper by force, threats and fraud, His punishment was fixed at two years confinement in the State penitentiary.
There was an issue of identity and of alibi which, on conflicting evidence and a proper charge, were determined against appellant. The assault took place about sundown on the evening of the 19th of June, on the public road at a point very near a store building and cold drink stand, at which there was in progress an emancipation day celebration.
