LOTTINGER, Judge.

This is a suit wherein the defendant pleaded discharge in bankruptcy in defense to a garnishment proceeding instituted against him.

The record points out that the defendant, Roosevelt Hurts, executed a promissory note on August 31, 1964, in the amount of $1,080.00. Nothing was paid on this note except the sum of $10.80 on October 31, 1964, which was credited to interest. On December 11, 1964, defendant filed a “Petition for Bankruptcy” in the United States District Court for the Eastern District of Louisiana.
