Defendant Ronald Tonaldi and two co-defendants were charged by indictment with unlawful possession of cocaine in excess of 30 grams and unlawful possession of pentobarbital. (Ill. Rev. Stat. 1977, ch. 56M, pars. 1402(a)(2), 1402(b).) Defendant and his co-defendants were represented by one retained lawyer. After a bench trial, defendant was found guilty of both charges. His co-defendants were found not guilty. Defendant was then sentenced to a term of 4 years.
