MEMORANDUM AND ORDER

ROGERS, District Judge.

This is a declaratory judgment action. Plaintiff asserts that defendant had a duty to defend and indemnify plaintiff in a lawsuit pursued against plaintiff by Devyn Falcon. This case is now before the court upon defendant’s summary judgment motion.
