Nicholas D. Gooding died in the town of Hoosick, Rensselaer county, on the 11th day of July, 1907, leaving him surviving his widow, Gertrude B. Gooding (formerly Gertrude B. Robinson), and her daughter, Grace M. Willis, the respondent.

His will was duly probated and the executor therein named qualified on the 31st day of July, 1907. A judicial settlement was had in 1913. The widow, Gertrude B. Gooding, afterwards married the petitioner, Chase G. Hathaway, and died in November, 1923, leaving a will which was duly probated in the Surrogate’s Court of Albany county. In her will the…
