The plaintiff’s declaration contains three counts, in each of which it is alleged that the defendant made and issued a certain obligation under seal for the payment of money, payable to the ordér of E. G. Kelley and William 0. Binney, who indorsed the same to the plaintiff. The copies annexed to the declaration showed that each of the obligations was in the form of a promissory note for $1000, in the name of the defendant, and signed by “ Wm. C.
