Michael Scott Sistler (“Defendant”) appeals his conviction for first-degree murder. On appeal, Defendant contends the trial court erred by denying his motions to dismiss the first-degree murder charge at the close of the State’s evidence and the close of all the evidence, and by denying Defendant’s motion for a mistrial after the prosecutor allegedly referred to evidence suppressed by a pre-trial suppression order.
