Abbott, J.:

This is an appeal by the State of Kansas from an order dismissing the criminal complaint charging Robbie Fitch with burglary and felony theft. The trial court dismissed the complaint on the grounds that Fitch was denied his constitutional right to a speedy trial.

The State contends the dismissal was premature, was not supported by the facts, and was an abuse of discretion by the trial court.

The complaint was filed on October 12, 1989. Fitch was arrested the same day and immediately released on bond. He has been free on bond since that time.…
