In an earlier action before this Court regarding the same set of events, we granted the defendant, Scott C. Ciak’s, petition for habeas corpus and vacated his conviction for possession of a firearm as a convicted felon in violation of 18 U.S.C. § 922(g)(1), finding that he had received constitutionally deficient representation at trial.
