Plaintiff, Donald Burton, a security fraud investigator with the Department of Revenue (Department), was discharged from his employment for unethical conduct arising out of the acceptance of a $20 gratuity from a taxpayer. Pursuant to section 11 of the Personnel Code (Ill. Rev. Stat. 1975, ch. 127, par. 63blll), a discharge hearing was conducted before a hearing officer appointed by the Civil Service Commission (Commission).
