Affirming.

By deed of date December 29, 1891, the appellant, Lewis Phillips, sold to Parish Arnett two hundred acres of land lying on Pricey Creek, in Magoffin County, at the price of $610.00. The deed acknowledged the payment of $300.00 of this amount and states that for the remainder of the consideration two notes were executed by Arnett, both of date December 29, 1891, the first for $100.00, payable four months after date, and the other for $210.00, payable one year after date.
