Appeal from District Court, Fifth District; Son. Joshua Greenwood, Judge. Action by A. Y. Hague against the Juab County Mill & Elevator Company. Judgment for plaintiff. Defendant appeals.

This was an action to enjoin the defendant corporation from maintaining a certain flume. The court granted the relief by issuing a perpetual injunction, and the defendant presents the record for review on appeal.

The injunction is based upon substantially the foEowing facts found by the court: That the respondent at all times mentioned in the findings was, and now is, the owner of certain parcels of land in Nephi City, Juab county, Utah, which are particularly described.
