Appeal from Saline Criminal Court. — How. John A. Rich, Judge. (1) It was error to allow the prosecuting attorney to file three amended informations. It is an abuse of his power. All amended informations being filed during the term of court and on day set for trial, one while jury was being examined on voir dire caused a continuance. Defendant being unable to give bail, it worked great hardship on him. It was repugnant to bis rights.

— The original information in this case was filed by the prosecuting attorney of Saline county on the 21st day of September, 1901. Various amended in-formations and motions to quash the same were filed until the 11th day of March, 1902, when the third amended information was filed by the prosecuting attorney. This last amended information contains three counts.
