HAYS, Justice.

Appellant, George Thorne, aka James Edward Whitney, was convicted of robbery with a prior, and was sentenced to 15 to 20 years imprisonment. From the judgment and sentence he appeals.

Appellant contends that he was deprived of his constitutional right to counsel at the police lineup, that a police officer’s reference to the defendant’s being in a lineup was error, that the robbery victim’s in-court identification of defendant was based on an illegal lineup, and that defendant’s waiver of counsel was accepted by the court without a determination that defendant was capable of…
