This appeal arises out of a controversy over the legality of a marketing program conducted in Iowa by Santa Rosa Sales and Marketing, Inc. (Santa Rosa). The State of Iowa, through the Attorney General and Superintendent of Securities (State), filed a petition in equity alleging that defendants, Santa Rosa and its president, Charles R. Groeschel, had violated the Iowa Consumer Fraud Act, Iowa Code section 714.16, 1 and the Iowa Uniform Securities Act, Iowa Code chapter 502.
